Warranty


What does this warranty cover? This warranty covers any defects in material or workmanship in your mouthguard unit (the “Product”) which cause injury or damage to the sound, natural teeth of the user of the Product when properly used in a supervised athletic contest or coach-supervised training session.

How long does coverage last? This warranty lasts for a period of one (1) year from the date you purchased the Product.

What will Soldier Sports do? Our obligation under this warranty will be to pay the user the lesser of: (1) actual dental expense incurred by the user; or (2) $1,562.50 per injured or replaced tooth, up to a maximum liability of $50,000 per incident.

Our obligation will be reduced by the amount of any insurance collected, available or payable for the injury or damage claimed.

What other exclusions and limitations apply? We will have no responsibility or liability under this warranty unless: (1) the Product was fitted in accordance with the printed instructions accompanying the Product; (2) a complete written notice of the injury or damage is received by us within 60 days of the date of such injury or damage; (3) the written notice specified in (2) is accompanied by a statement of a licensed dentist providing necessary treatment within 60 days of the date of such injury or damage and a statement of a participating game official (if injury or damage occurred at a supervised athletic contest) or a supervising coach (if injury or damage occurred at a training session) that the Product was in proper use at the time of the injury or damage; and (4) the Product is returned to us with the documentation specified in (2) and (3) above. The above items should be sent to us at Soldier Sports, L.L.C., 14013 Industrial Road, Omaha, NE 68144.

We will not, in any event, provide payment for orthodontic treatments or preparation of a tooth or teeth to be used as an anchor for a bridge.

In no event shall consequential and incidental damages be recoverable under this warranty. Some states do not allow the exclusion or limitation of incidental or consequential damages, so this limitation or exclusion may not apply to you.

How does state law apply? This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

THE FOREGOING WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE AND ANY IMPLIED WARRANTY ARISING OUT OF A COURSE OF DEALING, CUSTOM, USAGE OR DESIGN. EXCEPT AS OTHERWISE EXPRESSLY PROVIDED, SOLDIER SPORTS, L.L.C. DISCLAIMS ALL LIABILITY FOR LOSS, INJURY OR DAMAGE BASED UPON NEGLIGENT DESIGN OR DEFECTS IN MATERIALS AND WORKMANSHIP.
